Research concerning to the implementation of performance bond guarantee bank in the procurement agreement is intended to identify how the guarantee bank implementation at PT. Bank BRI branch Cik Ditiro Yogyakarta and rights implementation (accountability) of PT. Bank BRI branch Cik Ditiro Yogyakarta if guarantee recipients default. The research was conducted by empirical juridical approach, which field studied research prioritizes in order to obtain primary data or field data. As a first step of this research was also conducted with respect to the secondary data with juridical normative research, i.e by carried out literature research to obtain secondary data and then an examination of the data on field or on any party associated with the objects research to obtain the primary data The Research shows results that the implementation of a performance bond bank guarantee in a procurement agreement with PT. Bank BRI Co. Tbk. Cik Ditiro Yogyakarta branch has been implemented in accordance with the provisions of the law and other legislation prevail. The rights implementation (accountability) BRI as the guarantor is to pay compensation to the insured in the amount of the value indicated on the certificate guarantee execution guarantee (performance bond). The guarantee value derived from contra guarantees proposed BRI to insured recipients and henceforth is compensation given to the BRI. During contra guarantee claims can not be liquidated or be with drawn but can not meen the number of claims, then the remaining guaranteed payments are charged to the account and become effective for guarantee recipients
