PERLINDUNGAN HUKUM TERHADAP KREDITUR PEMEGANG SERTIFIKAT JAMINAN FIDUSIA DALAM HAL DEBITUR WANPRESTASI DAN MENGALIHKAN OBJEK JAMINAN (Studi Kasus Astra Credit Companies Cabang Surakarta)

Research on Legal Protection Against Creditors of Fiduciary Security Certificate Holders In The Debtor Default And Divert Object Guarantee (A Case Study of Astra Credit Companies Surakarta Branch) aims to determine the legal efforts undertaken by the certificate holder fiduciary creditor if the debtor defaults and transfer objects to a third party guarantee and the application of fiduciary provisions set out in article 36 of Law No. 42 of 1999 on Fiduciary Warranty. This research is a judicial empirical research, which explains about some provisions in the prevailing law and regulations in relation to the implementations in practice. The research data consists of secondary data obtained from library research and primary data obtained from field research. The collected data is then analyzed qualitatively and presented descriptively. The results of this study show legal efforts made by creditors fiduciary security certificate holder is not fully implemented. The legal process is going to stop at the level of detention without any cases that completed the trial level. Efforts consultation is preferred by creditors and debtors for the sake of efficiency in terms of both cost and in terms of time
