BAHASA KITAB UNDANG-UNDANG HUKUM PERDATA

This research aims to describe three issues that is, specific terms, sentences, functions of the use of KUH Perdata�s language. The research is done by using the qualitative-descriptive method which focuses on the aspecs of language in order to identify the patterns and the arrangement of principles in language by using qualitative model. The data are: words, clauses, and sentences in KUH Perdata as found in Subekti and Tjirosudibyo in 2009. Then, the data is analysed by using the language system�s analysis based on the behavior and the characteristics distribution of particular units of language. The units of language are observed from their relationship with another and also the contextual relationship. The result shows that: first, the KUH Perdata language is the translation from Burgerlijk Wetboek (BW) that is adapted into Indonesian civil law. It is showed from the using of Dutch, French, Latin, Portugese, England, Arabic, Sanskrit, Java, and Minangkabau�s terms. The loan terms is used to mention the specific law�s concept which is not included in Indonesian. Meanwhile in order to replace the other law�s concept in BW, it is used affixation words, reduplication words, and word combinations in Indonesian. The whole forms are used because they are easier to be arranged, more practical, and it can represent the real concept in Dutch. Then, the KUH Perdata language also has the BW characteristics especially in the arrangement of sentences that is: (a) KUH Perdata shows the complete law�s concept that consist of the law definitions and probabilities. So that, the complex sentence is more used than the simple sentences. (b) besides, KUH Perdata is arranged in unseparated chapter/article so that the information can not stand alone as the complete rule. This is showed by using of conjunction at the beginning of the sentences which contains the old information from the previous sentences. (c) In every civil law�s concept there must be the law information which is more focused rather than another information. It is proved by the using of conjunctions, prepositions, articles, adjunction words, numerical words, questioning words, combination word at the beginning of the sentences which functions as the particular information marker of civil law. Next, based on the units of characteristics, it can be concluded into four functions of the use of KUH Perdata�s language those are, the efficiency, the unity of thought, the comprehensive and the detail of information, and also the emphasis of law�s information
