State immunity from jurisdiction before the ECHR: the long shadow of Customary International Law

Durante las últimas dos décadas el Tribunal Europeo de Derechos Humanos (TEDH) ha dictado un conjunto de Decisiones sobre Admisibilidad y de Sentencias en las que aplica las normas de Derecho Internacional (DI) general en vigor que regulan la inmunidad de jurisdicción y de ejecución del Estado extranjero ante los tribunales del Estado del foro, fundamentalmente a los efectos de determinar si se ha vulnerado el derecho de acceso a los tribunales (art. 6.1 del Convenio de Roma). En su jurisprudencia el Tribunal de Estrasburgo se esfuerza por interpretar las disposiciones del Convenio de Roma buscando un resultado que sea coherente con el resto de normas del DI que vinculan a los Estados partes, y sin que hasta la fecha su labor judicial con relación al mencionado sector de normas haya puesto en riesgo la unidad del Ordenamiento internacional. En una perspectiva más general, se debe constatar que el TEDH proyecta en su jurisprudencia una concepción consensualista del ordenamiento internacional y de sus procesos de formación de normas.During the last two decades, the European Court of Human Rights (ECHR) has issued a set of decisions on admissibility and of judgments in which the court applies the general rules of international law (IL) that regulate the foreign state immunity from jurisdiction and enforcement before the forum of the state courts, mainly for determining whether the right of access to the courts has been violated (Article 6.1 of the Rome Convention). In its jurisprudence, the Court at Strasbourg endeavours to interpret the provisions of the Rome Convention seeking a result that is consistent with the other rules of the IL that bind states parties, and to date, its judicial work in relation to the above rules has not put at risk the unity of the international legal order.
