European Arrest Warrant in Theory and Practice

The bachelor thesis deals with the European Arrest Warrant in theory and practice. In the theoretical part, the thesis is primarily focused on the legal regulation of the international judicial cooperation in criminal matters within the European Union, its development from a historical perspective and its current status. In the second part, the thesis deals with the practical performance of the European Arrest Warrant and with the related complications. The issue here is, that after ten years of the enforcement of the European Arrest Warrant, many doubts over its performance and subsequent impact on the fundamental rights of citizens have raised.Tato bakalářská práce se zabývá evropským zatýkacím rozkazem v teorii a praxi. V rámci teoretického vymezení se práce zaměřuje především na právní zakotvení mezinárodní justiční spolupráce v trestních věcech v rámci Evropské unie, jejímu vývoji z historického hlediska a současnému stavu. Ve druhé části se práce zabývá praktickým vykonáváním evropského zatýkacího rozkazu a s tím spojenými problémy. Důvodem je skutečnost, že od počátku uplatňování evropského zatýkacího rozkazu uběhlo již 10 let a během této doby vyvstala řada pochybností nad jeho vykonáváním a následných dopadech na základní práva občanů
