Abstract Article 1 of the Marriage Act purpose of marriage is to establish a happy and lasting families based on God. There are various factors that can lead to divorce. It is as stipulated in Government Regulation No. KHI and 9 Year 1975 on the Implementation of the Law No. 1 Year 1974. Transitional or apostate religion can lead to disharmony in the household. The purpose of this study was to analyze the legal considerations to judge whether it is in accordance with Law 1 of 1974 and to analyze whether the decision of the Religious Court Judge Pekanbaru in the form of divorce decision is in conformity with the Act 1 in 1974. This type of research used in researching this issue is the method of normative (doctrinal legal research). Article 116 letter (h) Compilation of Islamic Law states that the conversion / apostates that causes in the household. Pekanbaru Religious Court Judge Decision No. 354 / Pdt.G / 2013 / PA.PBR has met the requirements specified in Law No. 1 of 1974. In pelaksaanan the judge's decision, the act of apostasy is rarely used as the main reason a divorce, apostasy more often a cause of other reasons, namely the emergence of disputes. Then the argument on which to decide the marriage is their continuous disputes and difficult to reconcile. The act of apostasy itself if done after marriage (marriage lasts longer and produce offspring), then if it has been proven in court that one of the parties married couple has lapsed then the judge can impose a divorce or grant imposition divorce. Key words: analysis juridical grounds divorce, apostate Abstrak Dalam Pasal 1 Undang-Undang Perkawinan tujuan perkawinan yaitu untuk membentuk keluarga yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Ada berbagai faktor yang bisa menyebabkan terjadinya perceraian. Hal ini sebagaimana yang diatur dalam KHI dan Peraturan Pemerintah No. 9 Tahun 1975 tentang Pelaksanaan UU No. 1 Tahun 1974. Peralihan agama atau murtad dapat menyebabkan terjadinya ketidakrukunan dalam rumah tangga.  Tujuan dari penelitian ini adalah untuk menganalisis pertimbangan hukum bagi Hakim apakah sudah sesuai dengan Undang-Undang No.1 tahun 1974 dan untuk menganalisis apakah putusan Hakim Pengadilan Agama Pekanbaru yang berupa putusan perceraian sudah sesuai dengan Undang-Undang No.1 tahun 1974. Jenis penelitian yang digunakan dalam meneliti permasalahan ini adalah dengan metode normatif (doktrinal legal research). Pasal 116 huruf (h) Kompilasi Hukum Islam menyatakan bahwa peralihan agama /murtad yang menyebabkan ketidak rukunan dalam rumah tangga. Putusan Hakim Pengadilan Agama Pekanbaru Nomor 354/Pdt.G/2013/PA.PBR telah memenuhi syarat-syarat yang ditentukan dalam Undang-Undang No.1 Tahun 1974 mengenai putusan perkara serta akibatnya jo Pasal dalam Peraturan Pemerintah No.9 Tahun 1975. Pasal 39 ayat (2) Undang-Undang No.1 Tahun 1974 bahwa untuk melakukan perceraian harus ada cukup alasan, bahwa antara suami istri itu tidak akan hidup rukun sebagai suami istri. Hakim menjadikan penjelasan Pasal 39 ayat (2) Undang-Undang No.1 Tahun 1974 jo Pasal 19 huruf (f) Peraturan Pemerintah No.9 Tahun 1975 sebagai salah satu alasan perceraian yaitu : â€antara suami istri terus menerus terjadi peselisihan dan pertengkaran dan tidak ada harapan akan hidup rukun lagi dalam rumah tanggaâ€.
