IMPLEMENTASI FUNGSI PENGAWASAN DPRD TERHADAP PELAKSANAAN PERATURAN DAERAH DAN PERATURAN BUPATI DI KABUPATEN KUTAI KARTANEGARA

Abstract Functions, duties, authority of parliaments lesser role optimally carry out the function of control in the implementation of local regulations. The purpose of this paper to examine and determine the function of Parliament oversight, to determine the answers and solutions to the problems in the practice of supervision of Parliament, and to provide solutions to the oversight function of Parliament in the implementation of the Regional Regulation and decree in Regency. This writing method of writing using juridical empirical sociological juridical approach, where the authors in formulating problems and objectives should be guided by the classification of judicial conduct and behavior nonyudisial, so the focus of empirical legal research more focused. Key words: implementation of regional regulation , regulation regent of kutai kartanegara , impementasi oversight function of parliament Abstrak  Fungsi, tugas, wewenang DPRD kurang berperan secara optimal mengemban fungsi kontrol terhadap pelaksanaan peraturan daerah. Sehingga fungsi pengawasan yang dijalankan DPRD belum/tidak dirasakan oleh masyarakat yang menimbulkan anggapan bahwa pengawasan DPRD kurang efektif dan tidak sesuai dengan harapan masyarakat. Kemudian kendala dalam hal fungsi pengawasan banyaknya Anggota DPRD kabupaten Kutai Kartanegara belum memahami fungsi pengawasan terhadap pelaksanaan Peraturan Daerah dan Peraturan Bupati. Lemahnya pengawasan oleh DPRD, diindikasikan dari banyaknya pengaduan masyarakat tentang ketidakberesan pelaksanaan pembangunan. Tujuan penulisan ini untuk mengkaji dan mengetahui fungsi pengawasan DPRD, untuk menentukan jawaban dan pemecahan masalah terhadap kendala dalam praktik pengawasan DPRD, dan untuk memberikan solusi terhadap fungsi pengawasan DPRD dalam pelaksanaan Peraturan Daerah dan Peraturan Bupati di Kabupaten Kutai Kartanegara. Penulisan ini menggunakan metode penulisan yuridis empiris yang menggunakan pendekatan yuridis sosiologis, dimana penulis dalam merumuskan masalah dan tujuan perlu berpedoman pada klasifikasi perilaku yudisial dan perilaku nonyudisial, sehingga fokus penelitian hukum empiris lebih terarah.
