Abstract The position of customary law is the law of life and thrive in the community. However, if customary law is not contrary to the interests of national law it is considered to remain in effect, however, on the contrary if it is considered customary law contrary to positive law or national law, the provisions of the applicable law it is written. Persintuhan between customary law and national law in the context of law enforcement (law ​​enforcement) certainly become part of the discourse of academic study in the field of criminal law in Indonesia. The conflict between the two laws in the domain of formal legal action would have been triggered judicial settlement mechanisms which tend to use aspects of the litigation that has formal characteristics. Subject is deemed reasonable given that adheres to the principles of criminal law, "lex scripta" and "lex certa" in which the principle of "nulla poena nullum delictum sine praevia lege poenali" prohibits enforceability unwritten law because they would threaten the rule of law is promoted as the main base validity of the criminal law. As criminal cases investigated by researchers associated with the practice of premeditated murder committed by tribal motifs Noaulu the action was based on action for the benefit of the customary ceremonial offerings. Key words: consideration, judge, customary law, judgment Abstrak Tradisi memenggal kepala dan mengambil bagian tubuh manusia (potong kapala) merupakan bagian dari potret tindakan primitif yang dijalankan oleh suku Noaulu untuk persembahan adat. Tindakan tersebut di kenakan sanksi sesuai pasal 340 jo pasal 55 ayat 1 ke-1 KUHP. Tulisan ini bertujuan mengkaji dan menganalisis dasar pertimbangan hukum hakim dalam menjatuhkan sanksi pidana mati dalam perkara pembunuhan berencana dengan motif persembahan upacara adat (potong kapala) oleh Suku Noaulu Maluku Tengah. Tulisan ini dibuat berdasarkan penelitian normatif yang menggunakan pendekatan perundang-undangan, pendekatan sejarah, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa Pelaku telah memenuhi unsur pembunuhan berencana sesuai dengan Pasal 340 KUHP, hakim mengendepankan asas fiksi hukum, yang menganggap semua orang tahu hukum (presumptio iures de iure). konsep tradisi memenggal kepala dilakukan berdasarkan restorative justice yang dimana penerapannya berupa penyuluhan hukum secara menyeluruh oleh pihak pemerintah pusat maupun daerah. Dalam konteks tersebut pemahaman untuk memberikan alternatif ritual adat mengayau yang memenggal kepala manusia agar secara komprehensif dapat digantikan dengan sarana yang lain semisal adanya upaya penggantian berupa hewan (sapi, kerbau,ataupun kuskus yaitu sejenis binatang hutan yang ada di wilayah pedalaman Suku Noaulu) dan/atau bahan pangan Kata kunci: pertimbangan, hakim, hukum adat, putusa
