AKIBAT HUKUM PERALIHAN HAK ATAS TANAH KARENA PEWARISAN YANG TIDAK DIDAFTARKAN PADA KANTOR PERTANAHAN MENURUT PASAL 42 PERATURAN PEMERINTAH NOMOR 24 TAHUN 1997 TENTANG PENDAFTARAN TANAH

Abstract This journal aims to identify and analyze due to the transfer of land rights laws because of heredity that are not registered at the land office under Article 42 of Government Regulation No. 24 Th 1997 and a form of legal protection for the heirs of the transfer of rights in land as perwarisannya not registered with the land office. This type of research is a normative juridical studies (Normative Legal Research) by using the approach of legislation that are conceptual. Then assisted with legal materials that will be outlined, described, and analyzed in relation to one another. Transitional land rights because heredity is not registered in the land office legal consequences: - heir as holders of land rights are not guaranteed legal certainty. Transition heirs land rights because perwarisannya not registered at the land office, basically because of the legal protection of material rights and obligations of the heir to skip ahead to the heirs as holders of rights to land and to this day still control the land. However, a form of legal protection given to different heirs have the registration of transfers of land rights because perwarisannya. This is because the heirs as holders of land rights has gotten stronger legal protection in the form of a certificate as proof of rights letter. Key words:transfer of land rights, inheritance, registration of land rights Abstrak Jurnal ini bertujuan untuk mengetahui dan menganalisis akibat hukum peralihan hak atas tanah karena perwarisan yang tidak didaftarkan pada kantor pertanahan menurut Pasal 42 PeraturanPemerintah No 24 Th 1997 dan wujud perlindungan hukum bagi ahli waris yang peralihan hak atas tanah karena perwarisannya tidak didaftarkan pada kantor pertanahan. Jenis penelitian ini merupakan penelitian Yuridis Normatif (Normatif Legal Research) dengan menggunakan pendekatan perundang-undangan yang bersifat konseptual. Kemudian dibantu dengan bahan-bahan hukum yang akan diuraikan, dideskripsikan, dan dianalisis keterkaitan satu sama lain. Â Peralihan hak atas tanah karena perwarisan yang tidak didaftarkan pada kantor pertanahan berakibat hukum :- ahli waris sebagai pemegang hak atas tanah tidak mendapat jaminan kepastian hukum. Ahli waris yang peralihan hak atas tanah karena perwarisannya tidak didaftarkan pada kantor pertanahan, pada dasarnya mendapat perlindungan hukum karena secara materiil hak dan kewajiban pewaris langsung beralih kepada ahli waris sebagai pemegang hak atas tanah dan sampai saat ini masih menguasai tanahnya. Akan tetapi, wujud perlindungan hukum yang diberikan berbeda kepada ahli waris yang sudah mendaftarkan peralihan hak atas tanah karena perwarisannya. Hal ini disebabkan karena ahli waris sebagai pemegang hak atas tanah telah mendapat perlindungan hukum yang lebih kuat berupa sertifikat sebagai surat tanda bukti hak.
