Derechos fundamentales y justicia distributiva

In this article the author argues about the difficult question concerning the normative status of social rights. Is analyzed if those rights are strictly speaking basic rights or if, as is argued for some critics, are merely aspirations of the society. The social rights´ fundamental character is defended on the basis of a description that demonstrates the existence of continuity between basic rights and social rights. Because of that, is sustained that is possible to show that both kind of rights constituted a system. It’s pointed out that social rights lack of efficiency (in Mexico, as well as in some important parts of Latin-Americans societies) cannot attribute to some anomaly. Instead, this is due to transgression of the serial or lexical order that define the system of the basic rights.Este artículo aborda la compleja cuestión del estatus normativo de los derechos sociales. En particular, se analiza si estos derechos son propiamente derechos fundamentales o si, como sustentan los críticos, son derechos que simplemente expresan aspiraciones de la sociedad. Se defiende en este artículo el carácter fundamental de los derechos sociales mediante una descripción que demuestra que existe entre los derechos fundamentales clásicos y los derechos sociales una continuidad, la cual hace posible afirmar que ambos conforman un sistema. Se señalará que la falta de eficiencia de los derechos sociales (en México, pero también en gran parte de las sociedades Latinoamericanas) no se puede atribuir a una anomalía de estos últimos, sino que ello se debe a una trasgresión del orden lexicográfico que define al sistema de los derechos fundamentales
