The paper deals with issues related to the development of legislation on new food and new food ingredients. The current regulations on new food are a compromise reached in a course of a long debate in which many doubts had to be addressed and clarified. The determination of the scope of legislation arose particular controversy. The preventive control in the process of procuring a permit to market new food was considered unproportional, and the differentiation between the application and notification procedures disputed. Other criticised issues included certain procedural matters and the labelling of new food seemed particularly controversial.
