Nowy model społecznego ubezpieczenia wypadkowego rolników

The aim of this paper was to present an attempt at the determination of a new model for accident protection in agriculture. The Author presented numerous de lege ferenda proposals both in terms of ex ante protection and ex post protection. The presented proposals include the association of accident protection with other types of social insurance in agriculture, together with the manner of its financing. In the conclusion the author stated that the new model of accident protection should to an adequate degree provide protection for individuals actually working in agriculture. The currently binding solutions need to be amended taking into consideration the essence and protective function of social insurance. Proposed actions require a definite distinction of accident protection insurance as well as changes in the manner of its financing. However, in order to ensure proper realisation of the functions of this insurance a certain involvement of state budget funds is required.Il lavoro svolto tenta di definire un nuovo modello di assicurazioni contro gli infortuni in agricoltura. L’Autore formula molte proposte de lege ferenda sia nell’ambito della tutela ex ante, che della tutela ex post. Le proposte avanzate prendono in considerazione le relazioni esistenti tra le assicurazioni contro gli infortuni e le altre assicurazioni sociali in agricoltura, nonché il relativo modo di attuazione. Secondo l’Autore il modello formulato è in grado di assicurare soddisfacente tutela alle persone impiegate in agricoltura. Le modifiche alle soluzioni vigenti dovrebbero essere effettuate tenendo conto della funzione protettiva che è propria delle assicurazioni sociali. Gli interventi proposti esigono una esplicita emanazione dell’assicurazione contro gli infortuni nonché una modifica delle modalità di finanziamento. Perché l’assicurazione sugli infortuni possa perseguire i suoi fini è necessario riservare alla stessa una quota di risorse nell’ambito del bilancio statale
