The debate about the possibility of equal treatment, regardless of gender, is ongoing and a constantly relevant topic. Previous research indicates that the sex of the defendant and victim has a significant impact on the possibility of a fair trial. The aim of this study, therefore, has been to investigate how victims are constructed through discourses in district court judgments and how this affects the possibility of a fair and objective judicial process. Judgements from 54 District Courts were examined through a critical discourse analysis. The results showed that there is a difference between how female and male victims are constructed in court cases and that an objective trial seems to be impossible to obtain
