Summary Human trafficking is a cynical trading with the opportunity for offenders to make big money. The risk to be tried in court is relatively small, and the penalty is relatively low. The vulnerable people in an unjust world, mainly women and children, become easy pray in this industry. We can pretend that this is not of our concern, but the bitter truth is the opposite. It is here, in the rich western world, that the foundation of this trading thrives. It is here that there is a demand. Sweden has nevertheless been a role model on the international arena in the fight against trafficking and sexual exploitation. Both with the introduction of a special penal provision in 2002, and as a leader in several international collaborations, Sweden shows a strong ambition to take action against trafficking. The question is whether we have lived up to our goal or not. This essay is a report on the penal provision. Background and development is reviewed, as well as the occasional criticism against it. There is a review of two selected court cases, the first and the latest judgement, followed with analyzes of the investigation, prosecution and judgement of those two. To sum up where we are today, the lawmakers are not quite there yet in terms of prosecution. On the other hand – it should no longer lie with the authorities of the law enforcement to take the final steps to make the prosecution effective. We have the penal provision. The police, prosecutors and courts have the knowledge. Risken att bli lagförd är relativt liten och straffen är förhållandevis låga. De stora orättvisorna i världen gör de utsatta människorna, främst kvinnor och barn, till ett lätt byte i denna industri. Visst finns möjligheten att tränga bort tanken att det skulle beröra oss, men den bittra sanningen är att det är just här, i den rika västvärlden som grunden till fenomenet frodas. Det är här som efterfrågan finns. Sverige har trots allt varit ett föredöme på den internationella arenan i kampen mot människohandel för sexuella ändamål och sexuell exploatering. Både med införandet av en speciell straffbestämmelse år 2002, och som ledande i flera internationella samarbeten, visar Sverige en stark ambition att bekämpa människohandel. Frågan är dock om vi har kunnat leva upp till målsättningen eller inte. I det här arbetet görs en redogörelse av straffbestämmelsen. Såväl bakgrund som utveckling behandlas och även den kritik som riktats mot den mellan varven. Vidare redogörs för två utvalda rättsfall, den första och den senaste domen. Därefter analyseras utredningen, åtalet och domen. Sammanfattningsvis kan det konstateras att lagstiftare fortfarande inte riktigt nått ända fram vad gäller lagföringen. Det torde dock inte längre ligga hos de rättstillämpande myndigheterna att ta de sista stegen för att en effektiv lagföring ska komma till stånd. Sverige har straffbestämmelsen.
