Proses Penyelesaian Sengketa Perbuatan Melawan Hukum Terhadap Harta Warisan Yang Telah Dijual (Studi Kasus di Pengadilan Negeri Surakarta)

Inheritance is a sensitive issue. Control of inheritance that has been sold unlawfully by another party can result in losses to those who should be entitled to the inheritance. In the analysis of the process of resolving disputes against the law against inherited property that has been sold, this study aims to determine the judge's consideration in determining the evidence in the process of resolving disputes against the law against inheritance that has been sold, to find out the judge's judgment in determining the decision in the process of dispute resolution. the act against the law and to find out the legal consequences after the case against the law of inheritance which has been sold is decided by the judge. This study uses a normative approach, because this research will be examined are legal principles, legal principles related to the process of resolving disputes against the law of inherited property that has been sold. This type of descriptive research is to clearly describe the process of resolving disputes against the law of inherited property that has been sold. The results showed that the Panel of Judges concluded that it was proven that the Defendants had committed acts against the law by controlling half of the disputed land owned by the Plaintiffs. Based on article 1365 of the Civil Law Code the Defendants committed acts against the law, the panel of judges stated in their decision that the Plaintiff's claim was granted in part, that the actions of the Defendants by controlling half of the disputed objects in the form of inherited land that had been sold were illegal acts so The Panel of Judges sentenced the Defendants to submit half of the object of the dispute to the Plaintiffs and to pay a loss of Rp. 10,000,000 (ten million rupiah) to the Plaintiffs. The legal consequences after the case against the law of inheritance which has been sold is decided by the judge, namely the Defendants as the losing party must implement the judge's decision and pay the stipulated case fee of Rp 3,236,000.00 (three million two hundred thirty-six thousand rupiah). If the Defendants do not want to surrender the land of the disputed object, the Plaintiffs can submit an Application for Execution to the Surakarta District Court against the Defendants
