Record changes arising from transexuality: jurisprudential analysis and considerations concerning the basis of the decisions based on the search of biological certainty and security rules of human person

In 2018, in Brazil, the Federal Supreme Court (Supremo Tribunal Federal - STF) assessed the Direct Unconstitutionality Action 4275, which questioned the restrictions on name and gender changes of transgender persons in the civil registry. Until this action, all the rectifications required judicial measures and there was no consensus in the judgments, and there were disagreements that ranged from the competence of the organs to which the requests would be addressed to the acceptance or not of the claim itself. This research presented and discussed elements that supported the favorable decisions and those that denying the judicial request in judgments realized by the Supreme Federal Court (Supremo Tribunal Federal - STF), Superior Court of Justice (Superior Tribunal de Justiça - STJ) and each of the State Courts of the country between 2007 and 2017, including the ADI 4275, according to the search criteria used. The research was structured in two papers. The title of the first is “Investigating the Courts: jurisprudential analysis on the pretensions of name change and sexual reassignment in Brazil between 2007 and 2017”. The second paper is entitled “A Matter of Law: The Recognition of the Self-Definition of Gender Identity by the Brazilian Supreme Court”. In these papers we have argued that the uncertainty or certainty legal about whether or not to obtain the positive outcome of the demand presented, not only kept transgender people in a precarious situation with respect to their recognition, but mainly demonstrated how the name remained tied to name-obligation and name-duty of police, in Brazil, although theoretically the name thesis was adopted as personality right. We also inquire about the displacement of the founding arguments of decisions, which gradually move away from medical knowledge towards the field of human rights.Tese (Doutorado)No Brasil, em 2018, foi apreciada pelo Supremo Tribunal Federal (STF) a Ação Direta de Inconstitucionalidade 4275, que questionava as restrições para as alterações de nome e de sexo de pessoas transexuais no registro civil. Até então, todas as retificações exigiam providências judiciais e não havia pacificidade nos julgamentos, ocorrendo divergências que iam desde a competência dos órgãos para onde os pedidos eram endereçados até o acolhimento ou não da própria pretensão. Este trabalho apresenta e discute os elementos que fundamentaram tanto as decisões favoráveis quanto as denegatórias das decisões proferidas pelo Supremo Tribunal Federal (STF), Superior Tribunal de Justiça (STJ) e por cada um dos Tribunais de Justiça dos estados do país entre os anos de 2007 e 2017, incluindo a própria ADI 4275, de acordo com os critérios de busca utilizados. O trabalho compõe-se de dois artigos. O primeiro intitulado “Perscrutando os Tribunais: análise jurisprudencial acerca das pretensões de mudança de nome e redesignação do estado sexual no brasil entre os anos de 2007 a 2017”. O segundo, intitulado “Uma questão de Direito: o reconhecimento da autodefinição da identidade de gênero pelo Supremo Tribunal Federal brasileiro”. Neles, argumentamos que a (in)segurança jurídica em relação à obtenção ou não do resultado positivo da demanda apresentada não somente mantinha as pessoas trans em uma situação de precariedade em relação ao seu reconhecimento, mas principalmente demonstrava como, no Brasil, o nome permanecia atrelado ao modelos de nome-obrigação e nome-poder de polícia, apesar de teoricamente ter sido adotada a tese do nome como direito de personalidade. Também indagamos acerca do deslocamento de argumentos fundamentadores das decisões, os quais afastam-se gradualmente do saber médico em direção ao campo dos Direitos Humanos.2021-12-1
