The charging of personal damages in work in the light of the 1988 Constitution: critical analysis of Law 13.467/2017

This paper aims to analyze a legislative change promoted by the labor reform (Law 13.467/2017) in relation to personal damages related to labor relations (art. 223-G, §1º, CLT). The methodology used was legal hermeneutics, with the aim of to interpret the art. 223-G, §1º, CLT, in the context of the brazilian legal system. The Law 13.467/2017 aligns with neoliberal ideals, a model that currently predominates in the global scenario, including in Brazil. Neoliberalism advocates the flexibilization and deregulation of working conditions as a way to benefit predatory capitalism by removing labor rights to increase profits in the business sector. The charging of personal damages directly violates the principle of human dignity by pricing the dignity of the worker, disregards the constitutional command of guaranteeing ample compensation for personal damages (art. 5, V and X, CF/88), violates the constitutional principle of equality, as well disregards the principle of prohibiting social regression. The art. 223-G, §1º, of the CLT, is not in line with the axiological matrix of the Federal Constitution, based on the valorization of the human being and guarantor of decent work.Pesquisa sem auxílio de agências de fomentoDissertação (Mestrado)Este trabalho tem o objetivo de analisar a alteração legislativa promovida pela reforma trabalhista (Lei 13.467/2017) em relação à tarifação dos danos extrapatrimoniais decorrentes das relações de trabalho (art. 223-G, §1º, da CLT). A metodologia utilizada foi a hermenêutica jurídica, com o intuito de interpretar o art. 223-G, §1º, da CLT, no contexto do ordenamento jurídico brasileiro. A Lei 13.467/2017 se alinha aos ideais neoliberais, modelo que atualmente predomina no cenário global, inclusive no Brasil. O neoliberalismo defende a flexibilização e a desregulamentação das condições de trabalho como forma de beneficiar o capitalismo predatório, retirando direitos trabalhistas para aumentar os lucros do setor empresarial. A tarifação do dano extrapatrimonial viola frontalmente o princípio da dignidade humana ao precificar a dignidade do trabalhador, desrespeita o comando constitucional da garantia à ampla compensação por danos extrapatrimoniais (art. 5º, V e X, da CF/88), afronta o princípio constitucional da igualdade, bem como desconsidera o princípio da vedação do retrocesso social. O art. 223-G, §1º, da CLT, não se coaduna com a matriz axiológica da Constituição Federal, pautada na valorização do ser humano e garantidora do trabalho digno
