Estudio descriptivo de la legislación en México en materia de los derechos de los animales no humanos

Recently, the enactment, declaration and adscription of several international agreements have led to government agendas, mainly underdeveloped, to give their attention to topics that, even though their respective legal framework and applicable regulations already existed, recent updates and formulations regarding new deals, have resulted in the reformulation of public policies aimed for them to be complied. In México, the observation or adoption of international agreements, especially the ones regarding environmental matters, are reflected in the reforms to the Constitution with the sole purpose of complying with said international agreements, thus, aligning the government’s agenda to the development and implementation of public policies. It’s necessary to say that, in this process of adaptation and alignment, many circumstances concur and, as a result, they lead to various consequences that, mainly, delay the legal or regulatory framework, or the institutionalization and implementation of public policies. These causes, in most cases, are based on economic, endogenous or transnational interests, which undoubtedly, lead the governmental and political attention to their attention spotlights. In the case of this work, the meaning and terms that the federal legislation and the laws of the federative entities consider regarding the matter of domestic animals are described, that is to say, regarding those animals that, based on their characteristics or attributes, represent purposes or utilitarian causes for the benefit of the human being. This work seeks to give a perspective of how these living beings are usually cataloged or categorized based on the Mexican positive law, under an anthropocentric approach, which codifies the “social” nature of these living beings by depriving them, in Descartes’ terms, of all similarities with the human being. By the social nature of the living being, we refer to the type of interaction that the animals, based on their behavior, represent to the human being regarding their strength, beauty, abilities, skills, etc. and as a result, we get to consider them utilities or benefits. From that point forward, we can propitiate a discussion about the nature of the relationships between the human being and living beings, about the ethic or moral quality of the human acts on account of the quality of life that other living beings deserve to have. From the legal standpoint, animals are not recognized as “beings” but as “objects”, they are deprived of all the qualities - similar to the human beings - of a living being and instead we make them mere objects, that either can be sold and negotiated, as well as used, consumed and finally disposed. It’s been a long time, but the discussion about the existence of animal rights has been constant and, given relevant environmental problems such as the loss of habitats due to large-scale fires or clandestine logging and timber trafficking, poaching, black market of living or dead specimens, mass extinction of species, etc. Recently, this discussion, to which can be added protests by environmental groups and animal protection groups, has had resonance on government agendas as well as within the United Nations where their Development Program (UNDP) has launched a global-level initiative recognizing the importance of the preservation, conservation and protection of the wildlife but under a vision of quality of life and respect from the human beings to other forms of life, which is called “animal welfare” and that is attached as a policy guideline when incorporated into the consideration of the Sustainable Development Goals (SDG), thus taking its due importance about respecting the life and welfare of animals and their deserved attention in the formulation of the agenda for the governance of any nation.Recientemente la promulgación, declaración y adscripción de diversos tratados internacionales han conducido a las agendas gubernamentales, principalmente subdesarrollados, a la atención de tópicos que si bien, ya existía el marco legal o normativa aplicables al respecto, las recientes actualizaciones o formulación de nuevos tratados, han derivado en la reformulación de políticas públicas orientadas a cumplir con ellas. En México, la observación o adopción de los tratados internacionales, caso concreto en materia ambiental por así abarcar el objeto de estudio, se reflejan en las reformas a la Constitución para dar cumplimiento al acuerdo internacional alineando así, la agenda gubernamental para el desarrollo e implementación de las políticas públicas objeto de la materia. Es necesario comentar que, en este proceso de adecuación o alineamiento, concurren diversas circunstancias que derivan en diversas consecuencias que principalmente, retrasan por mucho, la instrumentación del marco legal o normativo o bien, la institucionalización e implementación de la política pública. Estas causas en el mayor de los casos, se fundan en intereses económicos, endógenos o transnacionales, que indudablemente, conducen la atención gubernamental u política hacia sus escenarios o focos de atención. En el caso del presente trabajo, se describe el sentido y términos que guarda la legislación federal y las legislaciones de las entidades federativas en materia de la fauna no silvestre, es decir, de aquéllos animales que, con base a sus características u cualidades, representan fines o causas utilitarias en beneficio del ser humano. Se busca dar una dimensión de cómo estos seres vivos se catalogan o categorizan con base al derecho positivo mexicano, bajo de un enfoque antropocéntrico, el cual codifica la naturaleza “social” de estos seres vivos despojándoles -en términos de Descartes- de toda semejanza del ser humano. Por naturaleza social del ser vivo, nos referimos al tipo de interacción que los diversos animales con base a su comportamiento, representan al ser humano en razón de su fuerza, belleza, habilidades, destrezas, etc., una utilidad o beneficio y así, propiciar la discusión sobre la naturaleza de las relaciones entre el ser humano y los seres vivos, sobre la ética o calidad moral de los actos humanos en razón de la calidad de vida que merecen tener los demás seres vivos. Desde el plano legal, los animales no son reconocidos como sujetos de derecho sino como objetos, éstos se les despojan de toda cualidad -semejanza con el ser humano- de ser vivo convirtiéndose en simples objetos, susceptibles de mercado y negociación, así como de uso, consumo y disposición. Desde hace algunos ayeres, la discusión sobre la existencia de los derechos de los animales ha sido constante y dadas problemáticas ambientales relevantes tales como la pérdida de hábitats por incendios a gran escala o por la tala clandestina y tráfico de madera, la cacería furtiva, el mercado negro de ejemplares vivos o muertos, la extinción masiva de especies, etc. Recientemente esta discusión a la cual se suman manifestaciones por grupos ambientalistas y protectoras de animales, han tenido resonancia en las agendas gubernamentales así como en el seno de las Naciones Unidas donde el Programa para el Desarrollo (PNUD) ha lanzado una iniciativa a nivel global reconociendo la importancia en la preservación, conservación, protección tanto de la vida salvaje pero bajo una visión de calidad de vida y de respeto del ser humano a las demás formas de vida denominado bienestar animal y que se adjunta como una directriz de política al incorporarse en los Objetivos de Desarrollo Sustentables ODS cobrando así, la debida importancia del respeto a la vida y bienestar de los animales y su debida atención en la formulación de la agenda para la gobernanza de toda nación
