With the revision of UPOV Convention realised in 1991 the scope of protection conferred to the breeder developed a new plant variety has been significantly enlarged. It includes now not only the exclusive rights to exploit the variety but also the same rights referred to the varieties derived by the first. This improvement is a peculiarity of the Plant Variety Protection System, not present even in the Patent Protection System, and it has some juridical and practical consequences and effects that this study deeply analyses
