PERLINDUNGAN HUKUM TERHADAP DEBITUR PENANGGUNG DALAM PERJANJIAN PEMBIAYAAN KUMPULAN DENGAN SISTEM TANGGUNG RENTENG (STUDI KASUS PT MITRA BISNIS KELUARGA VENTURA)

Legal Protection for debtors is very important because their right as debtors who have obligation in joint and several liability systems would be fulfilled. Following the development of modern economy makes the human need increases, the fierce competition between business actors happens, and many of them have ambition to increase their business by borrowing capital. The form of the loss which experienced by debtors who have obligation for joint and several liability systems is if one of the debtors do default of contract so the other debtors get the effect of this. This happened at PT MBK where there was a debtor who defaulted. The group's obligation is to pay the debtor's performance, but due to the large number of installments, the group members object because other members also have to pay their loan installments. The occurrence of such defaults also affects the members of the group, namely the inability of the credit disbursement process. The debtor who bears it does not get the compensation for the debtor who defaultedTherefore, this research discuss about how is the legal protection for those who have obligation in financial debt agreement using joint and several liability systems in PT Mitra Bisnis Keluarga Ventura. This research is (field research) in which the researcher search and collect the data directly by interviewing the part of business actors as data collection technique in PT MBK Venture group exactly in Plosokuning IV village, Minomartani, Ngaglik, Sleman. In this research, the researcher also uses Legal protection, agreement, joints and liability system as the theory of the research. The result of the research shows that the debtors who use joint and liability system agreement have individual assurance, debtors who do inappropriate default of contract and against 1839 Indonesian Civil Code article’s. The practice of legal protection for debtors who have obligation is the protection through 1839 Indonesian Civil Code article’s, actually is not maximally work in protecting the debtors so the practice of injustice happens between the debtors who have obligation and the debtors who do default of contract. Legal efforts carried out by debtors who bear the obligations in the joint responsibility system are to hold group members' meetings, collect directly and report to local village officials with the aim of obtaining compensation from debtors who conduct defaults
