Indicadores de (in)eficacia del derecho ambiental. Una mirada exploratoria sobre la gestión legislativa en la Argentina

This article describes the latest advances of an exploratory research based on qualitative methodologies whose main topic is the (in)effectiveness of environmental law in Argentina. The work scrutinizes the labor carried out by the Legislative Power both at federal and at local levels (National Congress and Legislature of the Autonomous City of Buenos Aires) by applying objectively verifiable indicators within a logical framework approach. The study aims to discern the extent to which the seed of the ineffectiveness of environmental law in Argentina also depends on the parliamentary management, or if such ineffectiveness is the result solely to administrative and judicial actions. These two branches of the State were scrutinized by the Fundación Ambiente y Recursos Naturales (FARN) in two successive quantitative studies published in 2006. Therefore, the qualitative approach and the monitoring of the performance of legislative environmental management are areas of cognitive vacancy in Argentina at present. Accordingly, at this stage of our research, the comparative study with other countries is beyond the specific objective of this paper. The operationalization of the specific objectives of research plan has been made by using objectively verifiable indicators within a logical framework approach. To draw up a matrix of indicators applicable to legislative activities, the author of this paper has taken into consideration the matrix used by Inece to monitor the effectiveness of Environmental Law in the judicial and administrative fields. On this matrix basis a third matrix of indicators was developed to know the aspects of the legislative work that most affect the inefficiency of environmental law. Our research follows a qualitative-driven approach. The partial results obtained after two rounds of interviews with key informants in the legislative sector are detailed in this paper. Between both rounds of the survey some adjustments based on the experiences gathered were made, so we consider that this third matrix is still in its experimental phase.En esta publicación presentamos los avances de una investigación cualitativa de carácter exploratorio sobre la (in)eficacia del derecho ambiental en la Argentina, por medio del escrutinio de la acción legislativa tanto a escala federal (Congreso de la Nación) como local (Legislatura de la Ciudad Autónoma de Buenos Aires). El estudio pretende discernir si en la gestión parlamentaria se encuentra el germen de la ineficacia del derecho ambiental en la Argentina, o si tal ineficacia es fruto de la acción administrativa y judicial únicaente. Estos dos poderes del Estado los escrutó la Fundación Ambiente y Recursos Naturales (FARN) en sendos estudios cuantitativos publicados en el 2006. Por ende, el abordaje cualitativo y el monitoreo del desempeño de la gestión ambiental legislativa se presentan como áreas de vacancia cognitiva en la Argentina. En esta etapa de la investigación el estudio comparativo con otros países se ubica fuera de los objetivos específicos que nos hemos planteado. Para la operacionalización de los objetivos específicos hemos apelado al uso de indicadores verificables objetivamente dentro de un enfoque de marco lógico. Como punto de partida tomamos las dos matrices de indicadores elaboradas por la International Network for Environmental Compliance and Enforcement (INECE) para monitorear la eficacia del derecho ambiental en los ámbitos de la gestión judicial y de la administración pública. Sobre esa base matricial construimos una tercera matriz de indicadores con el fin de conocer los aspectos de la labor legislativa que más inciden en la ineficacia del derecho ambiental. Nuestra investigación, de sesgo cualitativo, presenta los resultados parciales obtenidos luego de dos rondas de entrevistas con informantes clave del sector legislativo. Entre una ronda y otra se realizaron ajustes sobre la base de las experiencias recogidas, por lo que consideramos que esta tercera matriz aún se encuentra en su fase experimental
