أبرز خصائص فقه القضاء في الإسلام

Praise be to God, Lord of the worlds -prayers and peace be upon the master of the messengers- our master Muhammad, and his family and companions. Islamic legislation is distinguished from other statutory legislation by establishing a unique judicial system, characterized by a set of characteristics and features, which made it more reasonable to achieve its goals, objectives, justice and fulfill the right. All those characteristics distinguished the Islamic legislation from other ones, and this is not excess or exaggeration; Rather, it is the truth that this scientific research has proven. By looking at all other studies, whether it is the studies of the old or modern scholars who studied the Islamic judiciary. These characteristics came scattered in their books, organized by this research to prove the fact of distinction of the judicial system in Islam. These characteristics are the relationship between the judiciary and doctrine, its independence from other authorities in the state, the people's trust in it, its observance of the psychological state of litigants and respect for their humanity, its fast action in considering and ruling disputes, seeking to achieve the utmost justice, and equality between opponents. This research was to study these characteristics and know the extent of their impact on the judiciary system in Islam, and how to benefit from them when developing this system, and to explain its merits and importance to other systems.الحمد لله رب العالمين، والصلاة والسلام على سيد المرسلين سيدنا محمد وعلى آله وأصحابه أجمعين أما بعد. يتميز التشريع الإسلامي عن غيره من التشريعات الوضعية الأخرى؛ بإرساء نظام قضائي فريد من نوعه، اتصف بمجموعة من الخصائص والمميزات، جعلته أكثر قدرة على تحقيق غاياته وأهدافه، وأقدر على تحقيق العدل وإحقاق الحق؛ ليتميز بتلك الخصائص عن غيره، وليس هذا تجاوزاً أو مغالاة؛ بل هي الحقيقة التي أثبتها هذا البحث العلمي، من خلال الاطلاع على كل الدراسات الأخرى، سواء كانت دراسات القدامى أم المحدثين من العلماء الذين درسوا القضاء الإسلامي؛ فجاءت هذه الخصائص منثورة في كتبهم، ينظمها هذا البحث لإثبات حقيقة التميز للنظام القضائي في الإسلام . وهذه الخصائص تتمثل في: ارتباط القضاء بالعقيدة، واستقلاله عن السلطات الأخرى في الدولة، وثقة الناس به، ومراعاته للحالة النفسية للمتقاضين واحترام إنسانيتهم، وسرعته في النظر في الخصومات والبتّ فيها، والسعي لتحقيق منتهى العدل، والمساواة بين الخصوم. فكان هذا البحث من أجل دراسة هذه الخصائص ومعرفة مدى تأثيرها على نظام القضاء في الإسلام، وكيفية الإفادة منها عند تطوير هذا النظام، وبيان فضله وأهميته على غيره من الأنظمة الأخرى
