Determinación de responsabilidad por daños causados por producto defectuoso: un régimen poco proteccionista

Consumer law is responsible for the protection of consumer rights, against the power asymmetry in relations with major producers. In Colombia, the Consumer Statute is intended to protect, promote and ensure the effectiveness and the free exercise of the rights of consumers. Although this law was presented as highly protectionist, it was very shy at regulating a subject of vital importance: the determining of liability for damages caused by defective products. The current procedure imposes very strict obligations to consumers, who are helpless against the obstacles of the system. Throughout this work, the reasons for this lack of protection for consumers will be studied and two proposals will be presented, in order to have an effective, modern and beneficial consumer law system, which truly acknowledges the state of vulnerability of consumers, and does protect them.El derecho del consumo está encargado de la protección de los derechos de los consumidores, frente a la asimetría de poder presente en las relaciones con los grandes productores. En Colombia, el Estatuto del Consumidor (Ley 1480 de 2011) tiene como objeto proteger, promover y garantizar la efectividad y el libre ejercicio de los derechos de los consumidores. Aun cuando esta ley se presentó como altamente proteccionista fue tímida en regular un tema de vital importancia: la determinación de responsabilidad por daños causados por productos defectuosos. El proceso actual impone unas obligaciones muy altas para los consumidores, quienes se encuentran desamparados frente a las trabas del sistema. A través del trabajo que aquí se resume se estudiaron los motivos de esta desprotección a los consumidores y se presentaron dos propuestas encaminadas a tener una ley efectiva, moderna y beneficiosa para los consumidores
