PENANGGULANGAN TINDAK PIDANA PENISTAAN AGAMA BERDASARKAN PASAL 156a KUHP DENGAN POTENSI KETIDAKADILAN DALAM PENEGAKAN HUKUMNYA

This thesis is entitled to alleviate the crime of blasphemy based on article 156a of KUHP with the potential for injustice in law enforcement with the aim to figuring out why the limits of criminal acts of blasphemy are unclear so that it has the potential to cause injustice in law enforcement. This type of research is normative legal research, with research methods through literature, journals and laws. The results of this study indicate that the boundaries of the criminal acts of blasphemy based on article 156a of KUHP are not clear because the background of the emergence of this article was to prevent the belief that blamed religion in Indonesia. These days Indonesia has evolved into an independent and free nation to embrace the freedom of belief or freedom of speech in accordance with the provisions of article18 of the Declaration of Law on Human Rights, but the boundaries of blasphemy acts are unclear and irrelevant to achieve legal certainty. The unclear explanation of what criminal act of blasphemy is make this article provide non-specifically gap of interpretation for law enforcers . Keywoard: blasphemy,criminal act, politic crimina
