PEMBAYARAN UANG TEBUSAN OLEH PENGGADAI KEPADA PEMEGANG GADAI TANAH PERTANIAN DI DESA LEWOLAGA KECAMATAN TITEHENA KABUPATEN FLORES TIMUR

The purpose of this research is to find out the ransom payment of agricultural land mortgaging from the land owner to the pledger in society ofLewolaga, Titehena, East Flores. The type of this research conducted by the author is normative legal research. The data sources used in this normative legal research are secondary data obtained through primary, secondary and tertiary legal materials. In this normative legal research, the data is collected from literature study by studying legislation, books, literatures, and interviewing competent speakers related to the title of the research. The conclusion is conducted through deductive thinking process that is departing from general proposition which truth is known (axiomatic) and ends at a specific conclusion as a new knowledge. Agricultural land mortgaging in Lewolaga Village is still based on customary law. Article 7 of Law number 56 Prp. of 1960 can not be applied in society because of its strong customary law. Agricultural land mortgaging is done based on the agreement of both parties specifically the land owner and the pledger. Keywords : agricultural land, mortgage, ransom paymen
