TRIAL BY THE PRESS DALAM PEMBERITAAN KASUS PELECEHAN SEKSUAL DENGAN KORBAN ANAK

Trial By The Press against the perpetrators of criminal acts often occurs, even though the criminal case is still under investigation, but the press through its reporting to judge the perpetrator. So that the perpetrators were coonered and insulted by the public, even though there was no Court Decision stating that the perpetrators were truly guilty. This happens as a consequence of guaranteeing freedom of press and also caused by the press inaccurate in obtaining and processing the information. The implementation of such a system raises problems, especially in reporting sexual abuse to child as victim which not only has an impact on the perpetrators, but also on victims who are judged by the press. The problems formulation in this thesis are focusing on two things, namely regarding : (1) What is the impact of Trial By The Press in reporting sexual abuse cases against child?, (2) What is the press responbility for the event of Trial By The Press? Researchers used a type of Normative Method by doing statute approach and conceptual approach. Primary and secondary data used are legislation, books, journals, and legal theses. By the legal research that has been carried out using the method, it can be concluded that, in the first problem formulation concerning the impacts of Trial By The Press in reporting sexual abuse cases against child as victim are mental suffering and victim-blaming by the public to the victim, whereas in the second problem formulation will be discussed regarding the press responbility for the occurence of Trial By The Press based of the laws of Republic Indonesia Number 40 Year 1999 about Press, the Code of Ethics of The Press, and the possibility of applying Penal Mediation as an alternative settlement
