EKSAMINASI PUTUSAN HAKIM TINDAK PIDANA KORUPSI SURABAYA NOMOR: 76/PID.SUS/TPK/2018/PN.SBY DITINJAU DARI PERSPEKTIF TUJUAN HUKUM

Criminal act of corruption by the charged PPTK officer Susilo Trimulyanto of BAPPEDA in Batu city showed the corruption law enforcement error which done by law enforcers especially the judges in give a decision must be based on one of legal purposes. This research took analysis the Surabaya Judges Corruption Decision number 76/Pid.Sus/TPK/2018/Pn.Sby viewed from the perspektif of Legal Purposes and error of the judges give legal considerans in the decision. This research used normative-juridical method. Its primary data resource taken from the types of rules of law and the secondary data resource taken from the library materials. The collection of data resources uses literature review. Based on the research results, the error of suspect/defendant establishment decree on this criminal act of corruption case has been found, it depends on the indictment that unable to explain the chronology clearly, completely and accurately. And also the error on the judge considerations to the defendant (Susilo Trimulyanto), which is contradicted by the principles and norms of law. The judgement is not based with the considerations. The court is interpretated the norms incorrectly that trespass the political will based on the rule of law making
