PERLINDUNGAN HUKUM DALAM PENETAPAN GANTI RUGI PENGADAAN TANAH JALAN TOL BERDASARKAN PERATURAN PRESIDEN NOMOR 71 TAHUN 2012 TENTANG PENYELENGGARAAN PENGADAAN TANAH BAGI PEMBANGUNAN UNTUK KEPENTINGAN UMUM (STUDI KASUS DI KECAMATAN LAWANG KABUPATEN MALANG)

ABSTRACT The research objective is to determine the implementation of the distribution of toll road land compensation, to determine the inhibiting factors in the implementation of compensation, and to find out the form of legal protection in the determination of toll road land compensation in the District of Malang Regency. The juridical empirical approach method and the approach used in this study is the statute approach and case approach. As a result of the research in the implementation of compensation for the toll road construction project, the land acquisition committee held a deliberation by inviting government agencies that need land and the owners to deliberate on the form and amount of compensation for the Land Price Assessment Team (appraisal) guidelines. Furthermore, the form of legal protection in land acquisition if the land owner who does not agree can file a lawsuit in court but the land acquisition process continues, usually not compensation but compensation because the price is above the market price and determined by the appraisal after the claim is received from the BPN. Key Word: Legal protection, Determination of Compensation, Land Acquisition ABSTRAKTujuan penelitian adalah untuk mengetahui pelaksanaan pembagian ganti rugi pengadaan tanah jalan tol, untuk mengetahui faktor-faktor penghambat dalam pelaksanaan pemberian ganti rugi, dan untuk mengetahui bentuk perlindungan hukum dalam penetapan ganti rugi pengadaan tanah jalan tol di Kecamatan Lawang Kabupaten Malang. Metode pendekatan yuridis empiris dan pendekatan yang digunakan di dalam penelitian ini adalah pendekatan undang-undang (statute approach) dan pendekatan kasus (case approach). Hasil penelitian dalam pelaksanaan pemberian ganti kerugian terhadap proyek pembangunan jalan tol tersebut, panitia pengadaan tanah dengan musyawarah dengan mengundang instansi pemerintah yang memerlukan tanah dan para pemilik untuk musyawarah mengenai bentuk dan besarnya ganti rugi pedoman Tim Penilai Harga Tanah (appraisal). Selanjutnya bentuk perlindungan hukum dalam pengadaan tanah jika pemilik tanah yang tidak setuju dapat mengajukan gugatan dipengadilan tetapi proses pengadaan tanahnya tetap berjalan, biasanya bukan ganti rugi tapi ganti untung karena harganya itu diatas harga pasaran dan ditentukan oleh appraisal setelah gugatan diterima dari BPN.
