AKIBAT HUKUM JUAL BELI IKAN KOI APABILA TERJADI WANPRESTASI

ABSTRACTSeveral problem of default recently happen in the process of selling and purchasing koi fish. If the dispute is brought to the court, the evidence is notstonr enough due tothe privately made agreement. Based on the background, this thesis has formulations of the problems concerning on: How is the process of selling and purchasing koi fish in Kemloko, Nglegok, Blitar. What are the factors that cause default in the process of selling and purchasing koi fish in Nglegok, Blitar. What are the legalconsequences if there are defaults and how to handle the situation. This study used empirical juridical. The result of the research shows us that in the process of selling and purchasing koi fish, there are wholesale(direct process), online, and auction. Late or bad payment from the purchaser. Both parties have to make the best agreement if there are suddenly some incidents outside the purposes of them.Keywords: Selling and purchasing, koi fish, and default. ABSTRAKMasalah wanprestasi sering terjadi pada jual beli ikan koi. Apabila sengketa tersebut dibawa ke pengadilan pembuktiannya kurang kuat karena perjanjiannya dibawah tangan. Berdasarkan latar belakang tersebut, skripsi ini mengangkat rumusan masalah sebagai berikut. Bagaimana proses pelaksanaan jual beli ikan koi di Desa Kemloko Kecamatan Nglegok Kabupaten Blitar. Apakah faktor-faktor yang menjadi penyebab terjadinya wanprestasi berkenaan dengan jual beli ikan koi di Kecamatan Nglegok Kabupaten Blitar. Apa akibat hukumnya apabila terjadi wanprestasi dan bagaimana upaya untuk mengatasinya. Penelitian ini menggunakan metode yuridis empiris. Hasil penelitian ini menyimpulkan bahwa pelaksanaan jual beli ikan koi yaitu, borongan (langsung), online, dan lelang. Pembayaran telat atau bahkan macet dari pihak pembeli. Kedua belah pihak membuat kesepakatan yang terbaik jika terjadi peristiwa di luar kehendak pihak penjual maupun pihak pembeli. Kata Kunci: Jual beli, ikan koi, dan wanprestasi
