PENGELOLAAN SUMBER DAYA ALAM MINYAK DAN GAS BERKAITAN DENGAN PENANAMAN MODAL ASING DI INDONESIA

When interpreted in stages based on effectiveness to achieve the greatest prosperity of the people of the functions of management (beheersdaad) being the most important. Pertamina is a manifestation of the state to carry out management functions. However, the nature of the oil and gas industry has a high risk, high capital and high knowlede so it is very difficult to manage all the natural resources of oil and gas. Ther fore we need cooperation countries with the International Oil Company (IOC)Minyak dan Gas Bumi merupakan sumber daya alam yang tak terbarukan yang ada di Indonesia. Mengingat pentingnya sumber daya alam migas maka migas dikuasai oleh negara. Penguasaan sumber daya alam migas di Indonesia berdasarkan Pasal 33 ayat (2) dan (3) Undang-Undang Dasar Negara Kesatuan Republik Indonesia tahun (UUD 1945). Dalam putusan Mahkamah Konstitusi 002/PUU-1/2003 tentang Uji Materi Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi mendefinisikan penguasaan negara adalah mengadakan fungsi kebijakan (beleid), tindakan pengurusan (bestuursdaad), pengaturan (regelendaad), pengelolaan (beheersdaad), dan pengawasan (toezichthoudensdaad) untuk tujuan sebesar-besarnya kemakmuran rakyat. Bila dimaknai secara bertingkat berdasarkan efektivitas untuk mencapai sebesar-besarnya kemakmuran rakyat maka fungsi pengelolaan (beheersdaad) menjadi yang paling utama. Pertamina merupakan perwujudan negara untuk menjalankan fungsi pengelolaan. Namun, industri migas memiliki sifat high risk, high capital, dan high knowlede sehingga sangat susah untuk mengelola semua SDA Migas.
