La parité en France et en Allemagne

Both France and Germany have taken into account the issue of the equal access of women and men to political functions, leading to the adoption of positive actions. However, in France, because of the Constitutional Council’s opposition against sex quotas in 1982, the constituent assembly intervened in 1999 to introduce within the Constitution the objective of equal access. It has based this reform on a register of justification specifically adapted to the French context, through the reference to the concept of “ parity”. On the contrary, in Germany, sex quotas have been spontaneously adopted by the political parties, so that these measures have been more effective than in France. Thus, a constitutional or legislative intervention has not been necessary ; besides, it is not certain that such a reform would have been legally admitted. Nevertheless, it seems that the gap between the two states, both regarding the register of justification of positive actions and regarding their implementation, tends to died down, notably owing to the common interventions of French and German legislators in order to favor substantive sex equality, beyond the political sphere.En France comme en Allemagne, la prise en compte de l’enjeu d’égal accès des femmes et des hommes aux fonctions politiques a conduit à l’adoption d’actions positives. Toutefois, en France, l’opposition de principe du Conseil constitutionnel contre les mesures de quotas par sexe en 1982 a conduit le constituant à intervenir en 1999 pour inscrire dans la Constitution l’objectif d’égal accès. Celui-ci s’est fondé sur un registre de justification spécifique au contexte français, par le renvoi au concept de «parité » . Au contraire, en Allemagne, les mesures de quotas ont été adoptées spontanément par les partis politiques, aboutissant à une plus grande efficacité des mesures qu’en France. L’intervention du constituant ou du législateur n’a pour cela pas été nécessaire ; il n’est du reste pas certain qu’elle aurait été juridiquement possible. Il semble néanmoins que l’écart entre les deux États, tant au regard du registre de justification des actions positives que de leur mise en oeuvre, tende à s’atténuer, notamment en raison de l’intervention commune des législateurs français et allemands pour favoriser l’égalité réelle des femmes et des hommes, au-delà de la simple sphère politique.Fondimare Elsa, Marguet Laurie.
