A family agreement “involves a transfer of an older person’s home or other assets to a trusted family member in exchange for a promise of long-term care and support.” (ALRC, Elder Abuse—A National Legal Response Report No 131 (2017) [6.1]) Such agreements may result in financial elder abuse when the promise of ongoing care is not fulfilled, or the relationship otherwise breaks down, and the older person is left without financial resources and/or accommodation. This presentation will consider: • Family agreements and Financial Elder Abuse • Barriers to access to justice • Equitable claims • Law reform proposal
