This is a time of regulatory reconsideration and transformation in Australia; when the long-held tradition of upholding ‘ipso facto’ clauses is under review as part of the Australian government’s innovation and reform agenda. The review forms part of the current conservative government’s policy to modernise, harmonise and strengthen Australia’s insolvency and restructuring laws, and to improve Australian business growth and economic prosperity. A proposal paper and model was released for public consultation with a submission deadline of May 2016. Subsequently, a draft exposure bill was released for consultation on 28 March 2017, seeking submissions by 24 April 2017
