La « domanialisation » de la propriété foncière en Algérie : la spoliation couverte de l’habit de la légalité

The Franco-Algerian history is above all the story of a dominium (domain), that is to say a power ratio to impose on a territory and to a people, it’s a unitary and absolutist nature of property right to introduce in a very complex land tenure. It is indeed the field that has been, during the first months of the conquest, object to the first regulations and legislation and has continued to be the base of extensive regulation of all kinds. Nevertheless one cannot understand the property system built by colonization by ignoring the pre-colonial structure of the area, and to grasp exactly what makes it special and gives it today a complex character where modern and traditional are combined : customary law (archs, mechmel, Melk), Islamic law (habous or waqf, kharadj), Ottoman law (beylik, azel, Makhzen), French law (public property / private property ...). My purpose here is to try to show, first, how the property duality was tested in Algeria in the mid nineteenth century whereas it was long kept apart from metropolitan law, and, secondly, how “ domanialisation of the property/ the ownership” has favored the passage from a variety to a duality of legal status.L’histoire franco-algérienne est avant tout l’histoire d’un dominium, c’est-à-dire un rapport de puissance à imposer à un territoire, un peuple et un droit de propriété de nature unitaire et absolutiste à introduire dans un régime foncier fort complexe. C’est en effet bien le domaine qui a fait l’objet dès les premiers mois de la conquête des tout premiers textes statutaires et n’a cessé d’être le siège d’une abondante réglementation en tous genres. Néanmoins l’on ne saurait comprendre le système domanial édifié par la colonisation en méconnaissant la structure précoloniale du domaine pour saisir ce qui fait précisément sa particularité et qui lui donne aujourd’hui un caractère complexe où se mêlent le moderne et le traditionnel : droit coutumier (archs, mechmel, melk), droit islamique (habous ou waqfs, kharâdj), droit ottoman (beylik, azel, makhzen), droit français (domaine public/ domaine privé…). Mon propos sera ici d’essayer de montrer, d’une part, comment la dualité domaniale fut expérimentée en Algérie dès le milieu du XIXe siècle pendant qu’elle a été éloignée longtemps du droit métropolitain et, d’autre part, comment la «domanialisation » de la propriété foncière a favorisé le passage de la variété à la dualité de statuts juridiques.Khalfoune Tahar.
