This thesis “Whether new democracies and emerging economies can implement ADR effectively in domestic judicial systems and use international experience as guidelines” is specifically concerned with the implementation of ADR methods in third world countries. Its purpose is to analyze what are the steps for proper implementation of ADR in emerging economies and illustrate what needs to be taken into consideration by demonstrating different examples. The thesis is composed of ten chapters, each of them dealing with different approaches and aspects of the topic. Its structure is divided in two main parts that go from general theoretical information in the first one to more detailed cases in the second one where everything previously exposed is shown from a practical standpoint. This first theoretical part concentrates on a brief explanation of the current state of ADR and the hypothesis that affirms the need of developing countries to take into consideration the experience of developed countries in this matter. Regarding all of this, this paper provides the hypothetical approach that can be created for ADR implementation in developing countries and recommendations to be taken into consideration by the implementers that carry out this process. After all of this, the thesis exposes what are the different methods of alternative disputes resolution in relation with developing countries and, taking into consideration the technological era we are living in, it adds one more method that is not commonly mentioned in implementation strategies: online disputes resolution. Finally, a practical part provides the examples of Bulgaria and Ghana to illustrate the process that these countries went through in their ADR implementation journey and analyzes the challenges that they had to overcome and the ones that they are still working on and how can this serve as an example for future implementations. Taking into consideration all the research made related with the mentioned content and, on the basis of the provided evidence that shows the success of ADR methods, this thesis concludes that proper implementation is beneficial in many aspects to any country. When it comes to developing countries, they will need to bear in mind the experience of developed countries but, in this process, never ignore their cultural background and traditions. All of this properly executed will assure an equal justice system that will enable everyone to access justice to solve disputes more effectively in a faster and more economical way than in traditional litigation.Teisės fakulteta
