A racionalização da intervenção estatal no direito de família

The Federal Constitution of 1988, symbol of the redemocratization of Brazil, and the Civil Code of 2002, extended the protection role to the families. It was advanced in the idea that the family was only that constituted by marriage to equate and protect the most diverse forms of contemporary families. A new age for family law began, where the constituent established a new commitment with Brazilian society and its base: the family. Prioritizing the principles of human dignity and substantial equality, among others, the family view had been re-signified. We pass through the rupture of the structural, patriarchal, patrimonial and matrimonialized model, in order to achieve the protection of affection, where the family is the cradle of the development of the personality of each individual. In this sense, it is necessary to reflect on the role of the State in this new conception of family and the new types of family that the law has been dealing with in recent years.Trabalho de Conclusão de Curso (Graduação)A Constituição Federal de 1988, símbolo da redemocratização do Brasil, e o Código Civil de 2002, ampliaram o rol de proteção às famílias. Avançou-se na ideia de que a família era apenas aquela constituída pelo matrimônio para equiparar e tutelar as mais diversas formas de famílias contemporâneas. Iniciou-se uma nova era para o direito de família, onde o constituinte estabeleceu um novo compromisso com a sociedade brasileira e a sua base: a família. Priorizando os princípios da dignidade da pessoa humana e da igualdade substancial, entre outros, a visão de família fora ressignificada. Passamos pela ruptura do modelo estrutural, patriarcal, patrimonialista e matrimonializado, para alcançarmos a tutela do afeto, onde a família é o berço do desenvolvimento da personalidade de cada indivíduo. Nesse sentido, é necessário refletir qual o papel do Estado nessa nova concepção de família e os novos tipos de família que o direito vem tendo que lidar nos últimos anos
