Models of Legal Regulation of Electronic Communications

The purpose of this thesis work is to reveal and asses the legal regulation in the electronic communications sector, its interaction with other social regulatory models applicable in the electronic communications. Research studies of substantial scope in the field of legal regulation of electronic communications, especially in the Lithuanian language, which also discuss the situation present in Lithuania, in this modern, extremely rapidly changing and converging sector are very rare and highly valuable. Scientific analysis of legal regulation models of an individual electronic communications sector is a new legal phenomenon in Lithuania. The attempts are made in the dissertation to research genesis, peculiarities of the electronic communications sector, its legal regulation, prerequisites for its formation and demand for such regulation, as well as the purposes of the legal regulation of this sector; to analyse the models of the existing legal regulation of electronic communications; to analyse and systemise other applicable legal and other social regulatory modes of the electronic communications; to project prognostic models of legal regulation of electronic communications. The thesis distinguishes and contains a thorough research of the models of legal regulation of electronic communications and other social regulatory models applicable in electronic communications, their potential interaction, harmonisation and balance. The distinguished models are of great value for research of complex phenomena, such as regulation. The model of social - legal phenomenon allows to highlight and research interrelations and regularity that are not noticeable in reality. Purification and research of the legal and social regulation models of the electronic communications represent significant element of scientific cognition by themselves, which provides prerequisites for making profound summaries and conclusions; development and verification of the phenomenon model enable deeper analysis of the phenomenon itself, with which new research studies can be conducted. With the use of the prognostic model, the ex ante legal regulation in the electronic communications, considering growing competition, is suggested in the dissertation to be replaced with the ex post legal regulation, by reserving its application to regulation of those important social relations, in which “harsh” social conflict may occur (e.g. for legal regulation of the competition field), while for other social relations, strict legal regulation should be replaced with other social regulation models (co-regulation and self-regulation).Disertaciniu tyrimu siekiama atskleisti ir įvertinti elektroninių komunikacijų sektoriaus teisinio reguliavimo, jo sąveikos su kitais elektroninėse komunikacijose taikytinais socialinio reguliavimo modeliais. Platesnės apimties moksliniai darbai elektroninių komunikacijų teisinio reguliavimo srityje, ypač lietuvių kalba, aptariantys ir situaciją Lietuvoje, šioje modernioje, itin dinamiškai kintančioje ir sparčiai konverguojančioje srityje yra labai reti ir vertingi. Mokslinė atskiro elektroninių komunikacijų sektoriaus teisinio reguliavimo modelių analizė yra naujas teisinis reiškinys Lietuvoje. Disertacijoje siekiama ištirti elektroninių komunikacijų sektoriaus, jo teisinio reguliavimo genezę, ypatumus, atsiradimo prielaidas ir tokio reguliavimo poreikį bei šio sektoriaus teisinio reguliavimo tikslus; išana-lizuoti esamo elektroninių komunikacijų teisinio reguliavimo modelius; išanalizuoti ir susisteminti kitus taikytinus elektroninių komunikacijų teisinio ir kitus socialinio reguliavimo būdus; sumodeliuoti elektroninių komunikacijų teisinio reguliavimo prognostinius modelius. Disertacijoje išskiriami ir detaliai tiriami elektroninių komunikacijų teisinio reguliavimo ir kiti elektroninėse komunikacijose taikytini socialinio reguliavimo modeliai, jų galima sąveika, derinimas bei balansas. Išskirti modeliai itin vertingi tiriant sudėtingus reiškinius, kokiu yra ir reguliavimas. Socialinio – teisinio reiškinio modelis leidžia išryškinti ir ištirti realybėje nepastebimus sąryšius bei dėsningumus. Elektroninių komunikacijų teisinio ir kitų socialinio reguliavimo modelių išgryninimas ir ištyrimas pats savaime yra reikšmingas mokslinio pažinimo elementas, leidžiantis daryti giluminius apibendrinimus ir išvadas; reiškinio modelio sukūrimas ir jo verifikavimas suteikia galimybę giliau analizuoti patį reiškinį, su kuriuo galima atlikti naujus tyrimus. Prognostiniu modeliu disertacijoje siūloma ex ante teisinį reguliavimą elektroninėse komunikacijose, atsižvelgiant į konkurencijos didėjimą, keisti į ex post teisinį reguliavimą, paliekant jo taikymą tiems svarbiausiems socialiniams santykiams reguliuoti, kuriuose galimas „aštrus“ socialinis konfliktas (pvz.: teisiškai reguliuoti konkurencijos sritį), o kitiems socialiniams santykiams griežtą teisinį reguliavimą keisti kitais socialinio reguliavimo modeliais (koreguliavimu ir savireguliavimu)
