Justicia restaurativa

The model ot Restoring lustice is conceived as a change in paradigm, a necessary support in order to achieve a new conception to administrating justice within the framework of a Social Sate of Law, reigned by its founding principle: “the Human Dignity” which abandons the repressive and retributive model thus reshaping the State’s role in exercising the ius punendi and considering the constitutional limits imposed on it, yet fundamentally considering the jurisdictional process as an instrument of peace.We therefore assume the supposal expounded by the model of Restoring Justice, which is the humanizing of the penal process, convoking unto the actors of the criminal conflict: the State, society, victimizer and victim, so that they would find a justly agreed upon solution to the criminal phenomenon, where it should be fundamental to reformulate the finality of the sentence, thus granting a protagonist role to the victim within the new accusatory penal process, endowing him with true process-part faculties, but over all respecting his human dignity.Se concibe el modelo de justicia restaurativa como un cambio de paradigma, soporte necesario para el logro de una nueva concepción de la administración de justicia, dentro del marco de un Estado Social de Derecho, regido por su principio fundante: “la dignidad humana”; que abandone el modelo represivo y retributivo, replanteando para ello el papel del Estado frente al ejercicio del ius punendi y considerando los límites constitucionales impuestos a éste, pero fundamentalmente considerando al proceso jurisdiccional como un instrumento de paz.Asumimos entonces, el supuesto que plantea el modelo de Justicia Restaurativa cual es la Humanización del proceso penal, a partir de la convocatoria de los actores del conflicto delictivo: Estado. Sociedad, victimario y víctima, para que en forma concertada y justa encuentren la solución al fenómeno delictual, cuya característica fundamental debe ser la reformulación de los fines de la pena, otorgando para ello, un papel protagónico a la víctima en el nuevo proceso penal acusatorio, dotándolo con verdaderas facultades de parte procesal, pero sobre todo respetando su dignidad humana
