Tort liability by autonomous vehicle accident

This study will analyze how the accidents involving autonomous vehicle will be resolved, in other words, how will be the legal solution on the resolution of the question. Such accidents already occurred and among others, with fatal victim. Through the analysis of the current legal framework and the work of experts in Brazil and on foreign legal systems, the purpose of this paper is to achieve a solution on the subject of the accidents that probably will occur. The results achieved is that in the absence of law regulating the topic, should be used analogy to fulfill the gap of the law. Should be used the consumerist law and the strict liability of the manufacturer, since the vehicle is a product, in a consumerist sense. Thus, the importance of this paper relies on the possible future discussions, since the autonomous vehicles will be more common in everyday life.Trabalho de Conclusão de Curso (Graduação)O presente estudo analisará de que maneira a questão de acidentes decorrentes de veículos autônomos será resolvida, ou seja, qual será a solução jurídica na resolução do problema. Tais acidentes já ocorreram, inclusive com uma vítima fatal até o momento. Por meio da analise da legislaç ao e dos entendimentos doutrinarios, do Brasil e do direito estrangeiro, ́̃́ o objetivo do trabalho é buscar trazer uma resposta à hipótese dos acidentes que porventura ocorrerão e que gerará dúvida quanto a sua solução. O resultado alcançado no estudo, resumidamente, é de que na falta de legislação acerca do assunto, deverá ser usado a analogia para suprir a lacuna do direito. Deverá ser usado o direito consumerista, com a responsabilização objetiva do fabricante, já que o veículo é um produto, nos moldes do Código de Defesa do Consumidor. Assim, esse trabalho encontra sua importâ ncia perante as possiveis discussoes futuras, conforme se fará mais presente os carros autônomos no ́̃ cotidiano
