Les aires marines protégées en haute mer et la difficile conciliation entre droit de la mer et droit de l’environnement

International audienceMarine protected areas are in the heart of the transformation of the Law of the Sea by the requirement to protect and preserve the marine environment, which is occurring since the 1990's. This conservation tool participates to the implementation of an « ecosystemic approach », and is one of the most important issues discussed now between States in the context of the negotiations of a new legally binding instrument under the LOSC, on marine biodiversity conservation beyond areas of national jurisdiction. Nonetheless, the effective creation of high seas MPAs remains confronted to several obstacles, inherent to the difficult conciliation between the Law of the Sea and environmental law, reducing the potential efficiency of MPAs. The future implementing agreement could however mitigate those limitations to the conservation of marine biodiversity in areas beyond national jurisdiction, depending on the approach retained, and on the final outcome of the discussions, which remains uncertain.Les aires marines protégées sont au coeur de la transformation du droit des océans par l'exigence de conservation de l'environnement marin, qui opère depuis les années 1990. Cet outil de conservation, participant d'une « approche écosystémique », constitue l'un des principaux éléments de discussion dans le cadre du futur accord de mise en oeuvre de la CNUDM relatif à la biodiversité au-delà des limites de la juridiction nationale. Cependant, la création de réseaux effectifs d'AMP en haute mer reste confrontée à d'importants obstacles, inhérents à la difficile conciliation entre droit de la mer et droit de l'environnement, qui amèneront à relativiser, voire remettre en cause, son efficacité potentielle dans ces espaces. Le futur accord de mise en oeuvre de la CNUDM pourrait néanmoins permettre d'atténuer ces différentes limites à la conservation de la biodiversité dans les zones maritimes internationales, selon l'approche retenue par celui-ci
