[EN] The protection of the photographic work presents different problems in the area of the Intellectual Property Rights. The Painer case treats on the protection of the photographic work in case of utilization of the same one, without assent of his author, for the location of a missing person. The Court of the European Union, in the judgment of 1 december 2011, Third Chamber, thinks that it is possible to publish a portrait photograph in a way of communication, in spite of not presentation of the assent of his authoress, adding a portrait photograph can, be protected by copyright if, which it is for the national court to determine in each case, such photograph is an intellectual creation of the author reflecting his personality.
