Il fenomeno della violenza domestica e della violenza di genere in Spagna: analisi di alcuni aspetti del suo trattamento processuale / The phenomena of domestic violence and gender violence in Spain: analysis of some aspects of their juridical treatment / Les phénomènes de violences domestique et de genre en Espagne : analyse de quelques aspects de leur traitement juridique

Both in the Spanish legal system as, in general, in comparative law, there are two distinct approaches to gender violence. On the one hand, there are supporters of “victim choice”, on the other hand, an approach supporting the benefits of the implementation of no-drop policies might prevail. In the Spanish legal system, both of these approaches coexist and this article aims to examine this. Moreover, in this paper, the author underlines in particular the difficulties coming from the numerous refusals to report such violence and from the frequent retractions of the victims of this kind of crime. Tant dans le système juridique espagnol que, en général, dans le droit comparé, il existe, en matière de violences liées au genre, deux positions : d’un côté, certains sont partisans d’une approche dite victim choice, de l’autre quelques-uns préfèreraient appliquer celle appelée no–drop policies. Dans le système juridique espagnol, ces deux positions coexistent et cet article a comme objectif de les examiner. En outre, dans ce texte, l’auteur souligne tout particulièrement les difficultés dues aux nombreux refus de déposer plainte et aux rétractations fréquentes des victimes, fréquents dans le cadre de ce type de violence
