Universalism of the right to education : its scope and limits

Toute réflexion sur l’homme et ses relations dans la société a une dimension universelle, une vocation universelle et des prétentions universalistes. Le droit à l’éducation, ou dans une vision plus restreinte le droit à l’instruction est un des droits-créances. Ce droit fondamental est d’une part, consacré à l’article 26 de la Déclaration universelle des droits de l’homme(DUDH) de 1948 et aux articles 13 et 14 du Pacte international relatif aux droits économiques, sociaux et culturels(PIDESC) de 1966 et d’autre part, dans les conventions régionales et catégorielles des droits de l’homme. Ce faisant, le droit à l’éducation est un droit de l’homme. Et il tire donc son universalisme de celui des droits de l’homme. Cependant, quoique consacré formellement, le droit à l’éducation est confronté à des difficultés de mise en oeuvre partout dans le monde nonobstant la contribution des Nations unies et ses organisations spécialisées pour assurer l’éducation pour tous. Sans nul doute, la nature programmatique du droit à l’éducation défendue par une partie de la doctrine pour réfuter sa justiciabilité constitue une limite à son universalisme. Le mouvement vers la justiciabilité observé à travers les décisions rendues par les organes juridictionnels nationaux, régionaux, et internationaux ainsi que les organes quasi-juridictionnels donne à espérer que l’universalisme du droit à l’éduction n’est pas une chimère.Any reflection on man and his relations in society has a universal dimension, a universal vocation, then universalist pretensions. The right to education, or in a more restricted view the right to ‘instruction’ is one of the rights-debts. This fundamental right is first enshrined in Article 26 of the 1948 Universal Declaration of Human Rights (UDHR) and Articles 13 and 14 of the International Treaty on Economic, Social and Cultural Rights (ITESCR) of 1966; also it takes place in the Regional and Categorial Human Rights Treaties. In doing so, the right to education is a human right. And it draws its universalism from that of human rights. However, although formally laid, the right to education is confronted with difficulties of implementation everywhere in the world, despite the contribution of the United Nations and its specialized organizations in ensuring education for all. Undoubtedly, the programmatic nature of the right to education defended by a part of the doctrine to refute its justiciability, is a limit to its universalism. We can observe a moving towards justiciability though the decisions of national, regional and international judicial bodies. Considering that, and also the functions of quasi-judicial bodies, we may hope that the universalism of the right to education is not a chimera
