Possibilidade de alteração do nome da mãe no registro civil do filho

ABSTRACT GOALS: This work aims to analyze the possibility of alteration of the mother’s name on the child’s civil record, after marriage, divorce and other possible situations. METHOD: Concerning the level of this research, we can say it’s exploratory. Concerning the method of approach, it’s classified as qualitative, taking into account that it analyzes the topics addressed, the principles, the doctrines related to the theme and the current case law; and, regarding the procedure of data collect, the research was made with bibliographic and documental methods. RESULTS: The constitutional principles that guide the Family Law are: The principle of equal treatment between children and spouses; the principle of family solidarity, the principle of dignity of the human being and the principle of affection. The concept of family has been developing and changing along with the society, giving birth to new kinds of family, beyond the matrimonial family, such as the common-law marriage and the one-parent family. Among the ways of separation of society and the matrimonial bond, we have the legal separation and the divorce. It has been observed that the personality is not considered a right, but it supports the rights and duties that come from it. The personality rights are divided by three categories: the right to physical integrity; the right to mental integrity; and the moral rights. The name is a sign that identifies the person and indicates their family origin, being guaranteed for the individual the right to protection of their name and their pseudonym. CONCLUSION: The name’s civil record is a right assured by law to the citizen, because it constitutes the proof of existence of the natural person and it can be used for the recognition of other rights. The Law of the Public Records establishes the possible situations when it’s allowed to alter the natural person’s civil name. Although, based on the principle of the human dignity, on the cases, allowed by law when the mother can change her civil name, it must be legal to alter the mother’s name on her child’s civil record.RESUMO OBJETIVO: Analisar a possibilidade de alteração do nome da mãe no registro civil do filho, após o casamento, divórcio e demais situações. MÉTODO: No que se refere ao nível, essa pesquisa é de natureza exploratória. Quanto ao método de abordagem, a pesquisa classifica-se como qualitativa, uma vez que analisa as situações abordadas, os princípios, as doutrinas vinculadas ao tema e entendimento dos tribunais; e, quanto ao procedimento de coleta de dados, a pesquisa foi realizada pelos métodos bibliográfico e documental. RESULTADOS: Os princípios constitucionais que norteiam o Direito de família são: o princípio da igualdade entrre filhos e cônjuges, o princípio da solidariedade familiar, o princípio da dignidade da pessoa humana e o princípio da afetividade. O conceito de família evoluiu acompanhando as transformações da sociedade, fazendo surgir novas configurações familiares, além da família matrimonial, como a união estável e a família monoparental. Dentre as formas de separação da sociedade e do vínculo conjugal estão a separação judicial e o divórcio. Verificou-se que a personalidade não é um direito, mas apoia os direitos e deveres que dela irradiam, sendo que os direitos da personalidade são divididos em 3 categorias: direito à integridade física; direito à integridade psíquica; e os direitos morais. O nome é o sinal que identifica a pessoa e indica a sua procedência familiar, tendo o indivíduo o direito à proteção do nome e do pseudônimo. CONCLUSÃO: O registro civil do nome é um direito assegurado por lei ao cidadão, pois constitui a prova da existência jurídica da pessoa natural, servindo de base para o reconhecimento dos demais direitos. A Lei de Registros Públicos estabelece as situações em que é possível a alteração do nome civil da pessoa natural. Entretanto, baseando-se no princípio da dignidade da pessoa humana, nos casos, permitidos pela legislação, em que a mãe pode mudar o nome civil deve-se admitir, da mesma forma, a alteração do nome da mãe no registro civil do filho
