Projeto de lei anticrime e os institutos ressocializadores da lei de execução penal

The present monograph has the objective of analyzing how proposals presented by the Anticrime Bill regarding the resocializing institutes provided for in the Criminal Execution Law. Concerning the methodological design, as far as the level of depth was used, exploratory research, while data were collected through bibliographic and documentary methods and a qualitative approach was also used. Synthesizing the content obtained through the theoretical study about punishment and the penal execution, it is extracted that the Federal Constitution and the relevant infraconstitucional legislations tried to instruct the individualization of the penalty as the main tool to be used to achieve the payment of the condemned to the social life and, consequently, achieve resocialization as the purpose of the penalty. Therefore, as regards the execution of the penalty, it is essential to effectively observance of the institute of progression of the prison regime, and that the enforcement of the reprimand does not obtain minimum period for the progression. Analyzing the proposals presented in the referred bill, it can be concluded that if approved, it will result in severe changes to criminal enforcement, complicating the re-socialization of the convict and the benefits.A presente monografia possui o objetivo de analisar as propostas apresentadas pelo Projeto de Lei Anticrime com relação aos institutos ressocializadores previstos na Lei de Execução Penal. Acerca do delineamento metodológico, empregou-se, quanto ao nível de profundidade, pesquisa exploratória, enquanto a coleta de dados se deu através dos métodos bibliográfico e documental, tendo sido utilizada, ainda, abordagem qualitativa. Sintetizando o conteúdo obtido através do estudo teórico acerca de pena e a execução penal, extrai-se que a Constituição Federal e as legislações infraconstitucionais pertinentes trataram de instruir a individualização da pena como a principal ferramenta a ser utilizada para atingir a integralização do condenado ao convívio social, e alcançar, consequentemente, a ressocialização enquanto finalidade da pena. Logo, no que concerne à execução da pena, faz-se imprescindível a efetiva observância do instituto da progressão de regime prisional, e que o cumprimento da reprimenda não obtenha período mínimo para a progressão. Analisando as propostas apresentadas no referido projeto de lei, conclui-se que, se for aprovado, acarretará em severas alterações para a execução penal, complicando a ressocialização do apenado e os benefícios
