Possibility of direct processing of police inquiry between prosecutors and judicial police

OBJECTIVE: The purpose of this monograph is to analyze whether the direct processing of the police inquiry between the Public Prosecution Service and the Judiciary Police, without the participation of the Judiciary, except in acts decisional nature, has constitutional backing, before the procedural system. prosecution and the fundamental guarantees inherent in citizens. METHOD: Regarding the depth level the research will be exploratory. Regarding the approach, it will be qualitative in nature. The procedure used for data collection will be the bibliographic as well as the documentary. RESULTS: It was found that the homeland procedural system has its founding nucleus in the prosecution system, thus, it was possible to determine the functions of the State Bodies in the pre-procedural phase, where it was determined that the Judiciary Police is essential to supplement criminal proceedings, subsidizing the accusatory body in the formation of opinio delicti. The parquet, for its part, has the task of promoting privately the public criminal action, according to the law; exercise external control over police activity, pursuant to the complementary law mentioned in the previous article; request investigative investigations and the initiation of a police inquiry, indicating the legal basis of their procedural statements. The Judiciary has action aimed at safeguarding the fundamental rights of the investigated in this investigative phase. In continuity, it was found that the infraconstitutional legislation that determines the triangular conduct of the police inquiry was not received by the new Constitutional order (art. 10, §§1º and 3º of the Code of Criminal Procedure). Therefore, the Federal Supreme Court must declare it unconstitutional and remove it from the legal system. CONCLUSION: It is concluded that the direct processing of inquiries is an inherent fact of the accusatory procedural system, since there is no constitutional support for the performance of the judiciary in the pre-procedural phase, justifying its action in actions that are subject to the reservation of jurisdiction, that is, that directly involve fundamental rights of the investigated. Thus, the Public Prosecution Service should be guaranteed the full exercise of its Constitutional function, being solely competent to make the decision to promote, not to promote and how to promote prosecution.OBJETIVO: A presente monografia tem por objetivo geral analisar se a tramitação direta do inquérito policial entre Ministério Público e Polícia Judiciária, sem a participação do Poder Judiciário, exceto nos atos de cunho decisório, possui respaldo constitucional, frente ao sistema processual acusatório e às garantias fundamentais inerentes aos cidadãos. MÉTODO: Quanto ao nível de profundidade a pesquisa será exploratória. Em relação à abordagem, será de natureza qualitativa. O procedimento utilizado para a coleta de dados será o bibliográfico, bem como o documental. RESULTADOS: Verificou-se que o sistema processual pátrio possui seu núcleo fundante no sistema acusatório, assim, foi possível determinar as funções dos Órgãos Estatais na fase pré-processual, onde se determinou que a Polícia Judiciária é essencial à suplementação da ação penal, subsidiando o Órgão acusatório na formação da opinio delicti. O parquet, por sua vez, detém a incumbência de promover privativamente a ação penal pública, na forma da lei; exercer o controle externo da atividade policial, na forma da lei complementar mencionada no artigo anterior; requisitar diligências investigatórias e a instauração de inquérito policial, indicados os fundamentos jurídicos de suas manifestações processuais. O Poder Judiciário possui atuação voltada a salvaguardar os direitos fundamentais do investigado nessa fase investigativa. Em continuidade, constatou-se que a legislação infraconstitucional que determina a tramitação triangular do inquérito policial não foi recepcionada pela nova ordem Constitucional (art. 10, §§1º e 3º do Código de Processo Penal). Logo, é necessário que o Supremo Tribunal Federal a declare inconstitucional e a afaste do ordenamento jurídico. CONCLUSÃO: Conclui-se que a tramitação direta dos inquéritos é fato inerente ao sistema processual acusatório, visto que não há respaldo Constitucional para a atuação do Poder Judiciário na fase pré-processual, somente justificando sua atuação em ações que sejam submetidas à reserva de jurisdição, isto é, que envolvam diretamente direitos fundamentais do investigado. Dessa forma, deve-se garantir ao Ministério Público o exercício pleno da sua função Constitucional, sendo o único competente para tomar a decisão de promover, de não promover e de como promover a ação penal
