A necessidade de se (re)pensar a realização do direito em tempos de protagonismo judicial – um percurso possível em busca de uma reflexão refundadora de um novo sentido

Law is inserted in the world of life. Itis therefore inextricably linked to social, cultural,economic and political contingencies. Law is adynamic science, which implies considering thatnew issues may become object of its interest orold issues may require current and committed reflections.One of the most recurrent issues in western philosophyof law and legal theory has been the understandingof the judge’s role and the limits of hisactivities. The judge has already been viewed as amere law enforcer, a neutral figure, radically impartial,whose role was restricted to pronouncingthe truth ontological-substantially provided in thelaw (viewed as an authoritative text). The legislativebranch was in charge of making laws and thejudicial branch was in charge of enforcing suchlaws – an ascetical division among governmentagencies, functions and authorities was conceived,grounded in the classical understanding of theprinciple of separation of powers. Creativity wasrestricted to the scope of the legislative functionexclusively performed by the legislative branch incontrast to the enforceability of jurisdiction. Nevertheless,is there a radical way to separate creationof law from “law enforcement”? We claimthere is not, that the court activity is unmistakablycreative, and the obligation to (re) think the judicialfunction and the role of judge is due to Courts,law professionals and legal scholars, especially intimes of judges playing the leading role.O Direito é uma ciência dinâmica, issoimplica considerar que novas questões podem vira ser objeto de interesse do Direito ou que velhasquestões podem demandar atuais e comprometidasreflexões. Uma das questões mais recorrentes no âmbito daFilosofia e da Teoria do Direito ocidentais temsido a compreensão do papel do juiz e os limitesda atividade que ele desempenha. O juiz já foiperspectivado como um mero aplicador de leis,uma figura radicalmente imparcial, cujo papelse restringia a pronunciar a verdade substancialontologicamenteencerrada na lei (enquanto texto de autoridade). Ao Poder Legislativo cabia a criação das leis e ao Poder Judiciário a aplicação dessas mesmas leis – concebia-se uma divisão asséptica entre orgãos funções, poderes estatais, ancorada na compreensão clássica do princípio da separação dos poderes. A criatividadese restringia ao âmbito da função legiferanteexercida exclusivamente pelo Poder Legislativo em contraposição a natureza execultória da jurisdição. Não obstante, há como separar radicalmente criação de “aplicação” do direito?Sustenta-se aqui que não; que a atividade jurisdicionalé iniludivelmente criativa, cabendoaos Tribunais e aos juristas, a obrigação de (re)pensar a função jurisdicional e o papel do juiz,especialmente em tempos de protagonismo judicial
