TINJAUAN YURIDIS KEDUDUKAN, TUGAS DAN WEWENANG KOMISI YUDISIAL DALAM HUKUM TATA NEGARA INDONESIA SEBAGAI LEMBAGA YANG MENJAGA DAN MENEGAKKAN KEHORMATAN, KELUHURAN MARTABAT, SERTA PERILAKU HAKIM

ABSTRACT The purpose of this study is to describe, firstly: has the position of Judicial Commission and in Indonesian Administration Law been in compliance with the duties and authorities provided by the 1945 Constitution of Republic of Indonesia? Secondly: What is the role of Judicial Commission in order to maintain and uphold the honor, nobleness of dignity, and behavior of judges? This research employs juridical normative research method consisting of primary, secondary, and tertiary legal materials. Result of the research, firstly: 1945 Constitution of Republic of Indonesia places the Judicial Commission in group of Justice Power which represents an independent state institution free of other state institutions’ intervention whose position is equivalent with the Supreme Court and Constitution Court. Secondly: Judicial Commission plays a role as an external supervisory institution of courts. However, in the Law No. 18 of 2011 puts more emphasizes on the role of Judicial Commission in supervision which is repressive compared to supervisory role which is preventive in nature.
