The Ins and Outs of Modern Ports: Rethinking Container Security

This paper specifically addresses those measures taken sinceSeptember 11, 2001, that deal directly with the security of our cargocontainers, the largest segment of the international supply chain. PartOne provides a backdrop for legislation of trade and port security. PartTwo discusses the law mandating various measures for cargo security.Part Three addresses differences between the industry experts andCongress on how best to tackle security issues relating to containers.The primary focus of this paper deals with the Security andAccountability for Every Port Act of 2006, which stands apart from theMaritime Transportation Security Act of 2002,\u27 but remains an integralpart of maritime security. The SAFE Port Ace brought together severalinitiatives already in practice, and some other seemingly unrelatedlegislation.3 The three initiatives discussed in this paper are theContainer Security Initiative, 4 Customs-Trade Partnership AgainstTerrorism, 5 and the much discussed 100 percent scanning amendment to the SAFE Ports Act, found in the Implementing Recommendations of the 9/11 Commission Act of 2007.
