Colombia: país donde abundan las leyes y escasea la legalidad

Dealing with the effectiveness of law and legality, and more specifically of the culture to grasp the law despite the regulations inflation and the prevailing conception of trying to solve all social problems with the issuing of legal rules is not a peaceful affair. Yet, our society must reflect whether it is moving towards the right path to make law a tool to model the behavior of its members or if it instead requires to decrease so much emphasis on the rule of law and better rely on the social and moral standard to reach higher levels of acceptance of the standard as part of the regularization in the daily decant of the individual. A reflection on the proposed order should not only lead us to consider that there is clearly a regulatory inefficiency and a generalized culture of neglect, but to rethink whether a country like ours deserves to demand such economic and institutional efforts to enact a legal framework that does not seem to fulfill its purpose.Ocuparnos de la eficacia del derecho y de la legalidad, y más específicamente de la cultura de aprehender el ordenamiento jurídico a pesar de la inflación normativa y de la concepción reinante de pretender resolver toda problemática social con la expedición de normas jurídicas no es un asunto pacífico. Sin embargo, nuestra sociedad debe reflexionar si está transitando el camino adecuado para hacer del derecho una herramienta que permita modelar las conductas de sus asociados o si, por el contrario, requiere no hacer tanto énfasis en la norma jurídica y más bien apoyarse en la norma social y moral para llegar a niveles mayores de aceptación de la norma como parte de la regularización en el trasegar cotidiano del individuo. Una reflexión en el orden planteado no solo debe llevarnos a considerar netamente la existencia de una ineficacia normativa y una cultura generalizada del incumplimiento, sino también a reformular si merece un país como el nuestro demandar tantos esfuerzos económicos e institucionales para dictar un marco jurídico que no parece cumplir su propósito
